ADMINISTRATIVE AND LEGAL ASPECTS OF THE USE OF VIDEO RECORDERS: GUARANTEES OF PROTECTION OR THREATS TO LAW AND ORDER

Abstract

The article examines the administrative and legal basis for the use of video recorders by citizens in Ukraine,  which is particularly important in the context of the digitalization of society and the increasing role of electronic evidence in judicial and administrative practice. It is argued that video recording is becoming an important tool for ensuring public safety, increasing the transparency of law enforcement agencies, and enabling citizens to exercise their constitutional right to participate in the protection of law and order. It is noted that video recorders perform a dual function: as a means of self-defense for individuals and as a source of evidence in legal relations, particularly in cases of administrative offences. Particular attention is paid to the analysis of the provisions of the Civil Code of Ukraine, which defines the limits of the admissibility of video recording of individuals without their consent. The importance of maintaining a balance between the right to privacy and the need to ensure public safety is emphasized, as imperfect legal regulation creates risks of personal rights violations and conflicts in the practical application of norms. It has been found that the lack of a unified regulatory framework for the recording and use of video recordings as evidence in administrative proceedings complicates the process of proving and requires further unification. 
It was concluded that effective legal regulation of the use of video recorders should be based on the principles of proportionality, legality, and information security. Proposals have been formulated to improve  legislation regarding the regulation of technical means of recording offences and expanding opportunities for citizens to participate in preventive activities together with law enforcement agencies. Additionally, it is emphasized that the systematic use of video recording can contribute to the formation of a culture of lawful  behavior and increase public trust in public institutions, which is an integral part of building a state governed by the rule of law.
