LEGAL ASPECTS OF THE FUNCTIONING OF STATE AUTHORITY BODIES DURING MARTIAL ARTS

Abstract

The article is devoted to a comprehensive analysis of the legal aspects of the functioning of state authorities of Ukraine under martial law. The study reveals the regulatory and legal principles of the introduction and implementation of the legal regime of martial law, in particular the provisions of the Constitution of Ukraine, the Law of Ukraine “On the Legal Regime of Martial Law” and a number of other regulatory and legal acts that determine the specifics of the activities of executive bodies, local state administrations, military administrations and local self-government bodies. The article indicates that the issue of expanding the powers of state authorities during martial law contributes to the effective coordination of actions in the areas of defense, public security and management of state resources. Analysis of the mechanisms of interaction of central and local authorities contributes to ensuring an immediate response to threats related to national security. Special attention is paid to the issues of delegation of powers and distribution of responsibility between different levels of state administration. The system of control over compliance with the law under the restrictions established by martial law is considered. The author emphasizes the importance of the balance between ensuring state security and respecting the constitutional rights and freedoms of citizens. The conclusions confirm that the introduction of martial law introduces changes to the activities of state authorities, granting them additional powers to urgently respond to threats arising in society. In this regard, it is important to strictly adhere to the principles of legality and proportionality, which would ensure the justification and necessity of the established restrictions on the rights of citizens. Maintaining a balance between the needs of national security and respecting human rights is one of the conditions for effective state administration during martial law. In view of this, further study of the features of improving the legal mechanisms for the functioning of state authorities is an important factor in strengthening the institutional stability of the state and ensuring its defense capability.
