ADAPTATION OF THE LEGAL REGULATION OF AGRICULTURAL PRODUCERS' ASSOCIATIONS TO EU REQUIREMENTS

Abstract

The article is devoted to the analysis of the current state and prospects for adaptation to the EU acquis of the
legal regulation of the formation and activities of agricultural producer associations in Ukraine in implementation
of the Association Agreement.
Based on the study of the provisions of Regulation (EU) No. 1308/2013 of the European Parliament and of the
Council of 17 December 2013 on the common organisation of the markets in agricultural products and repealing
Council Regulations (EEC) No. 922/72, (EEC) No. 234/79, (EC) No. 1037/2001 and (EC) No. 1234/2007 and
Commission Delegated Regulation (EU) 2016/232 of 15 December 2015 supplementing Regulation (EU) No.
1308/2013 of the European Parliament and of the Council as regards certain aspects of producer cooperation, the specifics of the legal mechanism for the recognition of producer organisations, associations of producer
organisations and interbranch organisations in agricultural sectors in the European Community have been
identified.
The article reveals that, in order to implement the Association Agreement, the draft law of Ukraine on
associations of agricultural producers (registration number 8149) was adopted as a basis two years ago in
accordance with the Resolution of the Verkhovna Rada of Ukraine dated May 2, 2023, however, it contains a
number of critical legal defects (excessive implementation of the provisions of Regulation No. 1308/2013 without
taking into account the existing regulatory framework in Ukraine; significant discrepancies between the draft law
of Ukraine on associations of agricultural producers and Regulation No. 1308/2013; significant legal defects in
the terminological apparatus; the presence of corruption-prone factors; the absence of specifics of legal regulation
of relations during martial law). The author justifies the need for significant revision of the draft law of Ukraine
on associations of agricultural producers in terms of eliminating corruption-generating factors and harmonizing
its provisions with national legislation and terminology, with Regulation (EU) No. 1308/2013 of the European
Parliament and of the Council and Commission Delegated Regulation (EU) 2016/232.
