CIVIL LAW PROTECTION OF THE INTERESTS OF INTELLECTUAL PROPERTY HOLDERS

Abstract

The article is devoted to the study of civil law protection of the interests of intellectual property subjects, in
particular to the analysis of the concept and legal nature of a legally protected interest within the system of civil
law, as well as the forms and methods of its protection. A legally protected interest in the field of intellectual
property constitutes an independent legal category that reflects the objectively determined need of a subject to
preserve and realize intangible and property benefits associated with the results of creative activity.
The paper examines the correlation between subjective rights and legitimate interests in the field of intellectual
property and determines their significance for ensuring an adequate level of legal protection of the results of
creative activity. The current civil legislation of Ukraine, judicial practice, and scholarly approaches to the
problem of protecting the interests of subjects of copyright and related rights, as well as rights to objects of
industrial property, are analyzed.
Particular attention is paid to the application of civil law remedies, including compensation for damages,
recovery of monetary compensation, cessation of infringements, and recognition of an interest as one that is
subject to legal protection. The necessity of improving the regulatory framework for civil law protection of the
interests of intellectual property subjects is substantiated, taking into account contemporary challenges of the
digital environment and law enforcement practice.
